EMERGENCY NOTICE OF INTENT TO WORK

Dear Mr. Bailey:

As per our phone conversation, the grade crossing surface at Flagler Street (W 13th Street) in the
City of Riviera Beach is failing and requires emergency maintenance to include track realignment which the Railway’s contractor will be performing on April 21, 2023. Allowable tolerances by FRA mandated guidelines have been exceeded, therefore, a slow order has been placed on the crossing, and this work must be completed immediately. We apologize for the short notice and inconvenience; however, the deficiency was just discovered during our most recent crossing and track inspection.

Therefore, the Railway will be required to rehabilitate this crossing under this year’s work to prevent further deterioration, and potential safety concerns.

In accordance with the terms of the agreement dated November 5, 2003, the cost of the crossing maintenance is the responsibility of the CITY, However, due to the short notice and emergency action needed, BrightLine and FEC will absorb the cost of all of the construction for this crossing rehab and maintenance. However, the current License Agreement is still in effect for all future crossing maintenance work as outlined in said current agreement.
